Acceptance of Terms

By purchasing, opening, or using our Products you agree to be bound by this Liability & Product Safety Statement and our Wholesale Terms (if applicable). If you do not accept these terms, do not use the Product and contact us within 14 days for return instructions.

1. Product Nature & Intended Use

Rich Roots fertilisers are dried mealworm frass formulated solely as a soil amendment/fertiliser. They are not for human or animal consumption. Follow on-pack directions.

To minimise health risks:

  • Avoid inhaling dust
  • Wear gloves when handling
  • Wash hands thoroughly after use
  • Keep out of reach of children and pets
  • Always use in well-ventilated areas

Regulatory notice – Rich Roots frass fertilisers are exempt from APVMA registration as “low-risk fertilisers” under the Agricultural and Veterinary Chemicals Code Act 1994 (Agvet Code). Labelling follows the National Code of Practice for Fertilizer Description & Labelling (2024). Handling is guided by industry best practices, including those outlined in the Fertilizer Handling Code of Practice (2016). COAs available on request.

Information we provide (website, social posts, flyers) is general in nature and does not constitute agronomic, veterinary or medical advice. Always follow local regulations and seek professional guidance where required.

2. Quality Assurance & Testing

Mealworms are raised on clean, plant-based feed and processed in a low-moisture, hygienic environment. We implement handling standards consistent with industry best practice to minimise potential risks, including those relating to pathogens and heavy metals.

We conduct periodic third-party tests on representative production lots. Certificates of Analysis (COAs) are available upon request for tested batches. Testing is not conducted on every individual batch.

3. Allergy Advisory

This product contains chitin (a protein from insect exoskeletons), which may trigger allergic reactions in individuals with known shellfish or insect allergies. Avoid direct contact and inhalation if allergic. This warning is also provided on product packaging.

4. Safe Handling Guidance

For bulk handling (e.g., scooping from larger sacks), we recommend:

  • Wearing a dust mask and gloves
  • Avoiding prolonged skin contact
  • Keeping sealed and stored in a cool, dry
    area (< 30 °C, < 65% RH)

Shelf life: 12–18 months from packing date. Nutrient content may decline gradually over time. Record batch/date codes and rotate stock first-in-first-out.

For commercial use or larger quantities, our Safety Data Sheet (SDS) is available.

The Product is classified as non-dangerous for road and air transport under the Australian Dangerous Goods Code (ADG 7.7) and IATA DGR; SDS contains full transport data.

5. Environmental Responsibility & Disposal

Unused fertiliser may be composted or disposed of with green waste.

Do not dispose into waterways or drains.

Ensure disposal complies with local council regulations.

6. Product Recall & Safety Notifications

In the unlikely event of a product recall or safety advisory:

  • Rich Roots will notify all wholesale partners within 48 hours via email and phone
  • Return, quarantine, or disposal instructions will be provided
  • Wholesale partners are responsible for informing their own downstream customers promptly

7. Limit of Liability

  • Except where the Australian Consumer Law (ACL) or any other law cannot be excluded, restricted or modified, our liability is limited to the ex-GST purchase price of the specific goods supplied.
  • We accept no liability for indirect or consequential loss, including lost crops, profits, or business interruption.
  • Claims must be made within 30 days of purchase and accompanied by proof of purchase and batch information.
  • Nothing in this clause limits liability for personal injury caused by negligence.

8. Indemnity for Wholesale Resale

To the extent permitted by law, wholesale buyers agree to:

  • Store and display products in accordance with Safe Handling Guidance (§4)
  • Ensure end customers are provided with appropriate usage directions (including those on-pack)
  • Indemnify Rich Roots against claims arising from improper use, incorrect branding, or failure to follow handling/storage instructions

This indemnity does not apply in cases of gross negligence or wilful misconduct by Rich Roots.

9. No Guarantee of Specific Results

Due to variables such as soil condition, plant species, climate, and user application, we do not guarantee specific plant performance outcomes or yield improvements. For commercial crops, seek independent agronomic advice before large-scale application.

10. Availability and Delivery

While we aim to ensure consistent supply, all products are subject to availability. Delays in shipment or restocking may occur due to raw material supply, weather events, or logistics disruptions. Rich Roots is not liable for delays outside our reasonable control.

11. Pricing & Tax

All prices are quoted in Australian Dollars and, unless otherwise stated, include GST. Prices are subject to change without notice. For wholesale partners, prices exclude GST unless specified.

12. Errors and Omissions

While we take care to ensure accuracy in labelling and product information, we are not liable for typographical errors, omissions, or unintended inaccuracies. Please contact us for clarification if unsure.

13. Website & Online-Ordering Disclaimer

We aim to keep our website secure and available 24 / 7, but maintenance, network outages or other issues may interrupt service. Display of a Product online does not guarantee availability; all orders are subject to confirmation. Rich Roots is not liable for delays, data-transmission errors or losses resulting from website downtime, internet latency or third-party payment-gateway faults. We reserve the right to cancel any order we reasonably suspect to be fraudulent or incorrect.

14. Force Majeure

Rich Roots is not liable for delay or failure to perform where caused by events outside our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government border closures or actions, strikes, transport or supply-chain disruptions, or utility outages.

15. Severability & Waiver

If any provision of this Statement is held invalid or unenforceable, the remainder remains in full force. A party’s waiver of any breach does not waive any other breach.

16. Updates to Statement

We may update this Statement by posting a revised version online. Continued purchase or use after the effective date constitutes acceptance.

17. Your Statutory Rights

Nothing in this Statement excludes, restricts or modifies rights under the Australian Consumer Law, including guarantees that Products are of acceptable quality, fit for purpose and as described.

18. Governing Law

This Statement and any sale of Rich Roots Products are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of Queensland courts.
